Terms of Service

These Terms of Service (“Agreement”) govern all photography services provided by JR Garcia Productions (“Photographer,” “we,” “our,” or “us”) to the client (“Client,” “you,” or “your”). By booking our services, purchasing digital or physical photo products, or otherwise engaging with our work, you agree to the following terms:

1. Services Provided

  • JR Garcia Productions offers professional photography services including, but not limited to, individual portraits, team/group photography, sports photography, events, and related photo products.

  • Services may include physical photo delivery, digital downloads, albums, prints, and other products as outlined in your order.

2. Booking & Payments

  • A deposit or full payment may be required at the time of booking. Services are not considered confirmed until payment is received.

  • All balances must be paid in full before delivery of digital or physical photo products.

  • Payment methods accepted include credit/debit card, electronic transfer, or other options as specified by JR Garcia Productions.

3. Delivery of Photos

  • Digital Delivery: Digital files will be delivered via secure online galleries or download links within the agreed-upon timeframe.

  • Physical Delivery: Prints, albums, or other tangible products will be delivered through the agreed-upon method (mail, courier, or hand delivery). Please allow 2–4 weeks for production and delivery unless otherwise specified.

  • Delivery times are estimates and may vary due to order volume, print lab timelines, or shipping delays.

4. Photo Selection & Editing

  • The Photographer will use professional judgment to select and edit images that meet our artistic standards.

  • RAW/unedited files are not provided under any circumstances.

  • Minor editing (color correction, cropping, exposure adjustments) is included. Additional retouching requests may incur extra fees.

5. Usage Rights & Copyright

  • All images are copyrighted by JR Garcia Productions and remain the intellectual property of the Photographer.

  • Clients are granted a personal use license to share, print, and display purchased images.

  • Images may not be altered, resold, or used for commercial purposes without prior written consent from JR Garcia Productions.

  • JR Garcia Productions reserves the right to use photographs for promotional purposes, portfolio, website, and social media unless otherwise agreed in writing.

6. Cancellations & Refunds

  • Cancellations made within 14 days of a scheduled session may result in forfeiture of the deposit.

  • No refunds will be issued once digital files or prints have been delivered.

  • In the rare event JR Garcia Productions is unable to provide services due to illness, emergency, or unforeseen circumstances, all payments will be refunded or a rescheduled session will be offered.

7. Client Responsibility

  • The Client is responsible for providing accurate information regarding event times, locations, and any specific photo requests.

  • The Client agrees to obtain necessary permissions for photography at venues or events.

8. Limitation of Liability

  • While every effort will be made to capture important moments, JR Garcia Productions cannot guarantee every requested image will be captured.

  • In the unlikely event of equipment failure, data loss, or unforeseen circumstances, liability is limited to rescheduling services or a full refund of payments made.

9. Chargebacks & Collections

  • Any chargeback or payment dispute filed without first contacting JR Garcia Productions to resolve the issue will result in immediate termination of future services.

  • Clients who initiate chargebacks will forfeit all rights to photos, galleries, and products provided, and may be permanently barred from booking future services.

  • The Client will be held responsible for any fees or costs associated with collections of unpaid balances.

10. Agreement

By booking photography services, making payment, or accepting delivery of digital/physical photos from JR Garcia Productions, the Client acknowledges and agrees to these Terms of Service.
